Terms and Conditions

Welcome to Unreleased Island. These terms and conditions ("Terms") govern your use of our online platform for artists to upload, share, and exchange unreleased tracks with curated access and traceable distribution (the "Service"). By accessing or using the Service, you agree to be bound by these Terms.

1. Account Registration

  • Eligibility: You must be at least 16 years old to use the Service. By creating an account, you represent and warrant that you meet this age requirement.
  • Account Approval: All account registrations are subject to manual review and approval. We reserve the right to decline any application without explanation.
  • Account Information: You are responsible for maintaining the confidentiality of your account credentials. You agree to provide accurate and up-to-date information during the registration process.
  • One Account Per Person: You may only operate one account. Multiple accounts used to bypass restrictions will result in permanent bans.

2. User Content

  • Ownership: Artists retain ownership of the tracks they upload to the Service. By uploading content, you grant Unreleased Island a non-exclusive, royalty-free license to use, reproduce, modify, publicly display, and distribute the content for the purposes of operating and promoting the Service.
  • Prohibited Content: You agree not to upload or share any content that infringes upon the intellectual property rights of others, contains explicit or offensive material, violates applicable laws, or is harmful to the Service or its users.
  • Content Removal: We reserve the right to remove any content that violates these Terms or our Community Rules, with or without notice.

3. Transactions and Exchange

  • Sales and Payments: Artists may list tracks for sale as collectible items priced in dBs (the platform's internal currency). Unreleased Island facilitates transactions but is not responsible for the actual exchange of funds. We may charge a commission or transaction fee for successful sales.
  • Exchanges: When two users mutually wishlist each other's tracks, an exchange is created automatically. Both parties are expected to honor exchanges in good faith.
  • Feedback: Users may provide feedback on tracks. Feedback should be constructive, respectful, and in compliance with our Community Rules.
  • Refunds: All dBs transactions are final. Refunds are handled on a case-by-case basis at our discretion.

4. Watermarking and Leak Protection

  • Identity-Tied Watermarks: Every track download is embedded with an invisible watermark uniquely tied to the recipient's account. This is a core security feature of the platform.
  • Prohibited Distribution: You may not redistribute, upload, share, or publicly distribute any track obtained through the Service. Downloaded tracks are for personal listening and professional use only.
  • Leak Consequences: If a watermarked track is found outside the platform, the responsible account will be permanently banned. Evidence may be shared with affected artists for legal follow-up.

5. Privacy and Data Protection

  • Data Collection: We collect and store certain personal and non-personal information as outlined in our Privacy Policy. By using the Service, you consent to the collection and processing of your data as described.
  • Third-Party Services: We use third-party services to enhance the functionality of the Service, including AWS S3 for storage, SendGrid for email, Buy Me a Coffee for subscriptions, and PayPal for payouts. These services have their own terms and privacy policies.
  • Cookies: We use strictly necessary cookies only (session and CSRF protection). See our Cookie Policy for details.

6. Intellectual Property

  • Platform IP: All trademarks, logos, and copyrighted material displayed on the Service are the property of Unreleased Island or their respective owners. You agree not to use or reproduce these without prior authorization.
  • Copyright Claims: If you believe your copyrighted work has been used without permission on the platform, please contact us through our Contact form with details of the alleged infringement.

7. Subscriptions and dBs

  • Subscription Plans: We offer Free, Starter, Intermediate, and Professional plans with varying upload slot limits. Paid subscriptions are managed through Buy Me a Coffee.
  • dBs Currency: dBs is an internal currency used for collecting tracks. dBs have no monetary value outside the platform and cannot be exchanged for real currency except through the official withdrawal process.
  • Withdrawals: Eligible producers may request dBs withdrawals to PayPal, subject to a minimum of 20 dBs per request and standard processing times. A 10% withdrawal fee is deducted from the withdrawn amount — this fee covers operational and payment processing costs. dBs-to-dBs track purchases carry no platform fee.
  • Plan Changes: Downgrading or cancelling a subscription may result in reduced upload slots and loss of premium features after a grace period.

8. Limitation of Liability

  • Use of the Service is at your own risk. Unreleased Island is not liable for any direct, indirect, incidental, consequential, or punitive damages arising from your use of the Service, including but not limited to loss of data, profits, or reputation.
  • Unreleased Island does not warrant the accuracy, completeness, or reliability of any content or information on the Service or guarantee uninterrupted or error-free access.
  • We are not responsible for disputes between users regarding track ownership, exchange fairness, or content quality.

9. Account Deletion

  • You may request account deletion at any time from your account settings. Deletion enters a 7-day grace period during which you may cancel the request.
  • Upon deletion, all your profile data, uploaded tracks, and transaction history are permanently removed. Users who purchased your tracks are notified to download before removal.
  • Watermark records may be retained after account deletion for platform integrity and leak investigation purposes.
  • Any remaining dBs balance is forfeited upon account deletion.

10. Modifications and Termination

  • We reserve the right to modify these Terms at any time. We will notify registered users of material changes via email or a notice on the Service. Your continued use of the Service after such modifications constitutes acceptance of the revised Terms.
  • We may suspend or terminate your account or access to the Service at any time, with or without cause, and without prior notice, including for violations of these Terms or our Community Rules.

11. Dispute Resolution

  • Any disputes arising from these Terms or your use of the Service should first be directed to our support team through the Contact form.
  • If a dispute cannot be resolved informally, it will be subject to binding arbitration in accordance with applicable laws.

12. Governing Law

These Terms are governed by and construed in accordance with the laws of the European Union and applicable member state legislation. Any disputes arising out of or relating to these Terms or the Service will be subject to the exclusive jurisdiction of the competent courts.

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that these Terms will otherwise remain in full force and effect.
